Terms of Use for Kelvin Camera

Effective date: July 7, 2026

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, in accordance with these Terms and Apple's App Store Terms of Service. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the App except where such restriction is prohibited by law.

2. Free Exploration and Kelvin Pro

The App is free to download and explore. Capturing photos requires an active Kelvin Pro purchase — one of the following:

• Kelvin Pro Monthly — auto-renewable subscription, billed monthly.
• Kelvin Pro Yearly — auto-renewable subscription, billed yearly.
• Kelvin Pro Lifetime — a one-time purchase that permanently unlocks the App on your Apple ID.

Current prices are always shown in the App before purchase.

3. Subscription Terms

Payment is charged to your Apple ID account at confirmation of purchase. New subscribers may be offered a free trial; you will not be charged if you cancel at least 24 hours before the trial ends. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the current period ends. You can manage or cancel subscriptions anytime in your device Settings → Apple ID → Subscriptions. Any unused portion of a free trial is forfeited when you purchase a subscription.

4. Refunds

All purchases are processed by Apple. Refund requests are handled exclusively by Apple under its terms — visit reportaproblem.apple.com. We cannot issue refunds directly.

5. Your Content

Photos you capture with the App are yours. They are stored in your device's photo library and never leave your device through the App. We claim no rights to your photos and have no access to them.

6. Acceptable Use

You agree to use the App in compliance with applicable law, including laws governing photography, privacy, and recording in your jurisdiction. You are solely responsible for what you photograph and how you use your photos.

7. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that photos will always be captured or saved successfully. Camera capabilities vary by device model and iOS version.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data (including photos), arising out of or related to your use of the App. Our total liability for any claim shall not exceed the amount you paid for the App in the twelve months preceding the claim.

9. Apple's Role

These Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the App and is not responsible for addressing any claims relating to it. Apple is a third-party beneficiary of these Terms and may enforce them against you.

10. Changes

We may update these Terms from time to time. Material changes will be reflected by an updated effective date on this page. Continued use of the App after changes take effect constitutes acceptance.

11. Termination

We may terminate or suspend your license if you breach these Terms. Sections 5, 7, 8, and 12 survive termination.

12. Governing Law

These Terms are governed by applicable consumer protection and data protection laws, including the EU General Data Protection Regulation (GDPR) where relevant. Nothing in these Terms limits any mandatory consumer rights you have under the law of your country of residence.
